1. Acceptance of these terms

These Terms of Service ("Terms") are an agreement between you and Empire AI ("AIM," "we," "us," or "our"), governing your use of the AIM web app, the AIM Telegram bot, and the AIM developer API (together, the "Service"). By creating an account or using the Service, you agree to these Terms. If you don't agree, please don't use the Service. Our Privacy Policy explains how we handle your information and is incorporated into these Terms by reference.

2. Eligibility & your account

You must be at least 13 years old to use AIM, and if you're under the age of majority where you live, you confirm you have a parent or guardian's permission. You're responsible for the accuracy of the information you provide when signing up, and for keeping your account credentials secure. You're responsible for activity that happens under your account, whether through the web app or a linked Telegram account.

3. Description of the service

AIM is a conversational AI assistant that can, depending on your plan:

  • Answer questions, hold conversations, and remember facts you ask it to
  • Search the web and summarize current information
  • Generate and edit documents, PDFs, images, and audio
  • Read and analyze files and images you upload
  • Offer an optional, clearly-labeled "Medical Mode" for informational health questions (see section 7)
  • Connect to Google (Calendar, Contacts, Sheets, YouTube, Gmail) and GitHub to take actions you request
  • Run multi-step, scheduled, or long-running tasks on your behalf
  • Offer chess practice and language-learning modules
  • Be accessed programmatically through a developer API (see section 10)

We may add, change, or remove features at any time, and some features are limited or unavailable depending on your plan.

4. Plans, billing & cancellation

AIM offers a Free plan and paid Basic and Pro plans, each with different message allowances, model access, and feature limits — see the Pricing page for current details. Limits reset daily; unused allowance does not roll over.

Paid plans are billed in advance on a recurring basis (monthly, unless stated otherwise) through Stripe or Flutterwave, depending on your region and payment method. By subscribing, you authorize us to charge your chosen payment method each billing cycle until you cancel. You can cancel anytime from Settings > Billing; cancellation takes effect at the end of your current billing period, and we don't provide partial-period refunds except where required by law.

We may change plan pricing or limits going forward; where required, we'll give you notice before a change takes effect on your next billing cycle.

5. Acceptable use

You agree not to use AIM to:

  • Break the law, or generate content that infringes someone else's rights
  • Generate or facilitate content that sexualizes or endangers minors, or any content otherwise prohibited by our usage policies
  • Attempt to reverse-engineer, scrape, or abuse the Service beyond your plan's intended use
  • Send spam, malware, or attempt to gain unauthorized access to AIM's systems or other users' accounts
  • Use a connected account (Google, GitHub, etc.) to take actions you're not authorized to take on that account
  • Circumvent rate limits, plan restrictions, or usage caps
  • Resell or redistribute access to the Service without our written permission

We may suspend or terminate accounts that violate this section — see section 11.

6. AI-generated content & its limits

AIM's responses are generated by AI models and may sometimes be inaccurate, incomplete, or out of date, even when stated confidently. You should independently verify anything important before relying on it — particularly factual claims, calculations, generated code, or anything with legal, financial, or safety consequences.

Nothing AIM generates constitutes professional legal, financial, medical, or other licensed advice, and using AIM does not create a professional relationship of that kind between you and us.

7. Medical Mode

Medical Mode is informational support, intended for situations where a real doctor isn't immediately available — it is not a diagnosis, not emergency medical care, and not a substitute for seeing a qualified healthcare professional. AIM will say so at the start of every Medical Mode conversation. If you're experiencing a medical emergency, contact your local emergency services immediately rather than using AIM.

8. Connected accounts & automated tasks

When you connect a third-party account (Google, GitHub, etc.) or set up a task for AIM to run — including tasks that run later, on a schedule, or across multiple steps — you are directing AIM to act on your behalf using that connection, within the scope of what you asked for. You are responsible for reviewing what a task or connected-account action will do before you set it up, and for the consequences of the instructions you give (for example, an email AIM sends because you asked it to, or a pull request it opens on a repo you granted access to). You can disconnect any account or cancel a pending task at any time from Settings.

We are not responsible for actions taken by AIM that faithfully carried out an instruction you gave, even if the outcome wasn't what you intended — review task descriptions carefully, especially for actions that send messages, spend money, or modify code or data you can't easily undo.

9. Your content & intellectual property

You retain ownership of the content you send AIM (your messages, uploads) and, to the extent applicable law allows, of the content AIM generates for you in response. You grant us a license to use, store, and process your content solely to provide and improve the Service, and you confirm you have the right to share any content you upload (including files from connected accounts).

AIM, the AIM name and logo, and the underlying software are our (or our licensors') property. Nothing in these Terms grants you rights to our trademarks or branding beyond what's needed to use the Service normally.

10. Developer API

If you use AIM's developer API, you're additionally responsible for keeping your API key confidential, for usage billed under your API account, and for ensuring your own application complies with section 5 (Acceptable use) when it calls AIM on behalf of your own users.

11. Suspension & termination

You may stop using AIM and delete your account at any time from Settings > Account. We may suspend or terminate your access if you violate these Terms, if required by law, or if we discontinue the Service, and we'll make reasonable efforts to notify you first except where immediate action is needed (for example, to prevent abuse or harm).

12. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that the Service will be uninterrupted, error-free, or that AI-generated content will be accurate or suitable for your purposes.

13. Limitation of liability

To the fullest extent permitted by law, AIM and its operators will not be liable for indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising from your use of the Service — including actions taken through a connected account or automated task you set up. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the three months before the claim arose, or ₦0 for Free-plan users.

14. Indemnification

You agree to indemnify and hold us harmless from claims, damages, and expenses (including reasonable legal fees) arising from your use of the Service, your content, your violation of these Terms, or your violation of any third party's rights.

15. Changes to these terms

We may update these Terms from time to time. If we make material changes, we'll update the "Effective" date above and, where appropriate, notify you directly. Continuing to use AIM after changes take effect means you accept the updated Terms.

16. Governing law

These Terms are governed by the laws of the Federal Republic of Nigeria, without regard to its conflict-of-laws principles. Any dispute arising from these Terms or the Service will be resolved in the courts of the Federal Republic of Nigeria, unless applicable law requires otherwise.
